Peru - Competition Law and Policy

Peru has been participating actively in the Competition Committee since 2011 and attends the Latin American Competition Forum and the Global Forum on Competition on a regular basis. It also hosted the 11th meeting of the OECD-IDB Latin American and Caribbean Competition Forum in September 2013. It also hosts the OECD Regional Centre for Competition in Latin America created in 2019.

Fighting bid rigging in the health sector in Peru: A review of public procurement at EsSalud

The Social Health Insurance agency of Peru, EsSalud, has invited the OECD to assess the public procurement framework applicable to their purchases in light of the OECD Recommendation and Guidelines for Fighting Bid Rigging in Public Procurement. The OECD issued a report in October 2021 with its assessment and specific recommendations to reinforce competition in tenders run by EsSalud, along with an action plan to implement these recommendations.

Peru underwent a peer review of its competition law and policy in 2018. This report describes and assesses the development of its competition regime, with a focus on current policy and enforcement, and the evolution of competition policy over the last few years. This review was undertaken under the auspices of the OECD/Inter-American Development Bank Latin American and Caribbean Forum.

Peru is one of the six Latin American countries having participated in a 2014 project to better understand how market studies are carried out and what can be done to improve them. More about the project

The resulting report outlines the current status of market studies in six Latin American countries, describes good practices, identifies areas for improvement and provides recommendations on how to make better use of this competition tool.
